1. The Service
Kastomise lets online merchants (“you”, “Merchant”) add a customisation experience to their product pages. Shoppers personalise a product with live 2D/3D preview, and once an order is paid a print-ready file is generated automatically. The Service is delivered via a script embed, a hosted product page, and a merchant dashboard for configuring products, branding, orders, and billing.
We may add, change, or remove features over time. Some features are released in beta and may be incomplete or unstable; they are provided “as is” without any commitment that they will reach general availability.
2. Accounts & eligibility
- You must provide accurate account information and keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity under your account, including that of your team members.
- You must be at least 18 years old and capable of forming a binding contract.
- You are responsible for the acts and omissions of anyone you invite to your account (admins, editors, viewers).
3. Subscriptions, billing & trials
Paid plans are billed as recurring monthly subscriptions in Australian Dollars (AUD) through our payment processor, Stripe. Pricing depends on the number of customisable products (“configs”) and the capabilities (2D, 3D preview, 3D teaser) on your plan.
- Trials. A free trial may be offered with limited capabilities and a watermarked preview. No card is required for the free tier.
- Upgrades take effect immediately and are prorated.
- Downgrades take effect at your next renewal. If a downgrade puts you over your plan’s config limit, the excess configs are automatically disabled without deleting your data; they re-enable when you upgrade again.
- Renewals. Subscriptions renew automatically until cancelled. You may cancel at any time; access continues until the end of the current billing period.
- Fees are non-refundable except where required by law. You are responsible for any applicable taxes.
4. Your content & your shoppers
“Merchant Content” means everything you or your shoppers upload or generate through the Service — product configurations, brand assets, fonts, 3D models, uploaded images, personalisation text, and the resulting design and print files. You retain all rights in your Merchant Content.
You grant Kastomise a worldwide, non-exclusive licence to host, process, transmit, and display Merchant Content solely to operate and improve the Service and to generate previews and print files on your behalf.
Your shoppers interact with the widget on your store, not with Kastomise directly. As between you and Kastomise, you are the controller of your shoppers’ personal data and Kastomise acts as your processor. Our handling of that data is described in the Privacy Policy. You are responsible for having a lawful basis to collect shopper data and for your own privacy disclosures to shoppers.
5. Acceptable use
You agree not to, and not to permit others to:
- upload or produce content that is unlawful, infringing, defamatory, or that violates a third party’s intellectual-property or privacy rights;
- reverse engineer, decompile, scrape, or attempt to extract the source code, configuration logic, or positioning algorithms of the Service;
- resell, sublicense, or white-label the Service beyond the embedding rights expressly granted, or use it to build a competing product;
- interfere with or overload the Service, circumvent usage limits, or probe its security;
- use the Service to send spam or malware.
6. Intellectual property
The Service, including the customisation engine, dashboard, rendering pipeline, and all related software, design, and documentation, is owned by Kastomise and protected by intellectual-property laws. These Terms grant you a limited, revocable, non-transferable right to use the Service; no other rights are granted. “Kastomise” and our logos are our trademarks and may not be used without permission.
7. Third-party services
The Service integrates with third parties such as Shopify, Stripe, and cloud infrastructure providers. Your use of those services is subject to their own terms, and we are not responsible for their acts, omissions, or availability. You are responsible for maintaining any third-party accounts and credentials you connect to Kastomise.
8. Print output
Kastomise generates print files based on the configurations you set and the selections your shoppers make. You are responsible for reviewing your product configurations, dimensions, colour handling, and fulfilment. Previews are representations and may differ from a physical product due to materials, printing, and display differences. Kastomise is not the manufacturer or fulfiller of any physical goods.
9. Warranties & disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.
10. Limitation of liability
To the maximum extent permitted by law, Kastomise will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid to Kastomise in the twelve (12) months before the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold Kastomise harmless from any claims, damages, and costs (including reasonable legal fees) arising from your Merchant Content, your use of the Service, your products sold to shoppers, or your breach of these Terms.
12. Suspension & termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that risks harm to others or to the Service. On termination, your right to use the Service ends; we may delete Merchant Content after a reasonable retention period, subject to the Privacy Policy.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or an in-dashboard notice). Continuing to use the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of its courts, without regard to conflict-of-laws rules.
